Terms for Artists

Overview

This website is operated by Outline Tattoo Ltd. Throughout the site, the terms “we”, “us” and “our” refer to Outline Tattoo Ltd. Outline Tattoo Ltd offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By creating an account as a tattoo artist on this website, you engage in our “Service” and agree to be bound by the following artist's terms and conditions (“Artist's Terms and Conditions”, “Terms for Artists”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

Section 1 - Artist Account

To create an account as a tattoo artist on this website, you agree to provide certain information. After creating your login details, you will then need to connect your bank account to the website payment platform using your bank account details (powered and secured by Stripe), to enable your tattoo artist account to take bookings and payments. You will need to provide your full name, email address and mobile number, date of birth, home address, a scan of your ID (passport, driving license, or identity card), and a scan of proof of address, to verify yourself with the website payment platform (again, all powered by Stripe).

You agree that all account management is your responsibility. You will manage your tattoo flash library by uploading or deleting flash entries.

Section 2 - Payments from Customers

Visitors to our website ("Customers") will be able to purchase and make bookings for flash designs that you have uploaded to your account. The Customer's payment through our website will be powered by Stripe. The money will instantly leave the Customer's bank account, and will be held by Stripe. You must then agree a booking date that the Customer confirms on our website, within the next 10 days, for the payment to go through to your bank account. If a date is not agreed within 10 days (we will assist in finding a date and preventing this), then the payment is automatically refunded to the Customer.

Section 3 - After Initial Bookings

We agree to attempt to accommodate potential date changes to the booking, as long as notice of 3 weeks before the date of tattooing is provided. However, we provide no guarantee to the Customer that any requests for amendments will be possible, once the initial date has been agreed by you, the artist. If either a Customer or an Artist wishes to amend the booking date, they must communicate this by contacting Outline Tattoo Ltd first. Ultimately, any change in booking date must be confirmed by you, so there is no risk of you being frustrated by the Customer.

You agree to tattoo the Customer's booked flash at the agreed booking time and date, and at the agreed location. If you fail to complete a booking with a completed payment and confirmed date, we reserve the right to remove your profile from our website.

Section 4 - Representations

This section contains important promises between you, Outline Tattoo Ltd, and the Customer. You agree that you have the authority to agree to these Terms and to perform all of its obligations under these Terms. You agree that the manner your perform your services, its work product, and any background IP it uses comply with all applicable laws and regulations in the territories relevant to the provision or receipt of the services under these Terms.

Section 5 - Confidential Information

You and Outline Tattoo Ltd shall comply with its relevant obligations under the Data Protection Act 1998 and associated codes of practice when processing personal data in connection with these Terms.

Section 6 - Indemnity

This section transfers certain risks between you and Outline Tattoo Ltd if a third party sues or goes after you or Outline Tattoo Ltd. For example, if we get sued for something that you did, then we may require you to help in our defence and/or to reimburse us for any losses.

You agree to indemnify Outlined Tattoo Ltd (and its affiliates and its and their directors, officers, employees, and agents) from and against all liabilities, losses, damages, and expenses (including reasonable attorneys’ fees) related to a third-party claim or proceeding arising out of: (i) the work you have done under these Terms; (ii) a breach by you of your obligations under these Terms; or (iii) a breach by you of the promises you are making in SECTION 4 Representations.

We agree to indemnify you (and your affiliates and your and their directors, officers, employees, and agents) from and against liabilities, losses, damages, and expenses (including reasonable attorneys’ fees) related to a third-party claim or proceeding arising out of a breach by us of its obligations under these Terms.

In respect of any indemnity claim pursuant to this Section, the indemnified party shall: (i) promptly notify the indemnifying party of the relevant claim; (ii) not make any admission or otherwise compromise or settle the claim; and (iii) provide the indemnifying party with all such assistance as the indemnifying party may reasonably require in respect of the claim.

You'll need to connect to our payment provider

Setting up an artist account should take 5 mins. After creating your Outline login, you'll need to provide your bank account details (and a few other details) to our secure provider — Stripe.

You're in charge of managing your flash

While your tattoo portfolio on Outline is fully automated from Instagram, you need to manually manage your flash library. We are not responsible for removing outdated flash or adding new flash (although we will of course attempt to solve any potential problem if customers purchase outdated flash, etc).

You'll receive tattoo booking payments 10 days after a customer purchases, if you've confirmed a date

While a customer does pay for a booking instantly, the money is held securely with Stripe. You must confirm a date for the booking, with the customer, for the money to be moved to your account. If not confirmed within 10 days, the customer will be refunded.

You're protected from late date change requests, no-shows, etc

Once a customer has agreed a date with you, they have no guarantee they can change the date or request a refund. If they do request a date change way ahead of time, we will work with both parties to try and find a solution. Ultimately, everything must be approved by you, the artist.
